1. Service Description
ZeroTrace provides an automated GDPR data access and removal service. We act on your behalf, under your signed Power of Attorney, to send legally binding data access requests (GDPR Art. 15) and erasure requests (GDPR Art. 17) to data brokers and people-search websites that hold your personal information.
2. Eligibility
Our service is available to individuals residing in the European Union (EU) and European Economic Area (EEA) who are at least 18 years old. By creating an account, you confirm that you meet these requirements.
3. Account Registration & Power of Attorney
To use ZeroTrace, you must create an account and provide accurate personal information (name, email, address). You must sign a digital Power of Attorney authorizing ZeroTrace to act as your legal representative for the purpose of exercising your GDPR rights. You are responsible for keeping your account credentials secure. The information you provide must be accurate, as it is used to identify your records at data brokers.
4. Subscription & Payments
ZeroTrace offers subscription-based plans billed monthly or annually. Payments are processed securely by Stripe. You may cancel your subscription at any time. Upon cancellation, your service continues until the end of the current billing period. Refunds are handled in accordance with EU consumer protection regulations and our 14-day cooling-off period for digital services.
5. What We Do and Do Not Guarantee
We guarantee that all GDPR requests are sent in full legal compliance using your Power of Attorney. We track responses, enforce the 30-day legal deadline, and escalate non-compliant companies. However, we cannot guarantee that every data broker will comply, as enforcement ultimately depends on regulatory authorities. We do not guarantee specific removal rates, as some brokers may have legitimate legal grounds to retain certain data.
6. Data Protection
Your privacy is our core business. We process your personal data exclusively for the purpose of providing our service. We never sell, trade, or share your data for marketing or any other commercial purpose. Full details are in our Privacy Policy.
7. Your Obligations
You agree to: provide accurate and truthful personal information; not use the service for fraudulent purposes; not create accounts on behalf of others without their explicit consent; comply with all applicable laws.
8. Limitation of Liability
ZeroTrace acts as your authorized representative and exercises due diligence in sending GDPR requests. We are not liable for the actions or inactions of third-party data brokers. Our total liability is limited to the amount you paid for the service in the preceding 12 months. This limitation does not apply to damages caused by intentional misconduct or gross negligence.
9. Termination
You may terminate your account at any time. Upon termination, we will complete any GDPR requests already in progress and delete your personal data within 30 days. We reserve the right to suspend or terminate accounts that violate these terms.
10. Governing Law & Dispute Resolution
These terms are governed by the laws of the European Union and the applicable national law of your country of residence. Any disputes shall be resolved through the Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr) or the competent courts of your place of residence.
11. Changes to These Terms
We may update these terms from time to time. We will notify you of material changes via email at least 30 days before they take effect. Continued use of the service after changes become effective constitutes acceptance of the updated terms.
